AEO and CBAM: the next steps of the European green customs

The carbon border adjustment mechanism aiming to fight the import of goods (e.g steel) which do not comply with the EU criteria of sustainability enter into force on 1.10.2023.

In this interesting to recall that according to article 36 paragraph 3 of the in the “Proposal for a regulation of the European Parliament and of the Council establishing a carbon border adjustement mechanism (COM(2021)0564 – C9-0328/2021 – 2021/0214(COD))” published on 8.02.2023“…(a) Articles 5 and 17 shall apply from 31 December 2024. (b) Articles 2(2), 4, 6, 7, 8, 9, 14, 15, 16, 19, 20, 21, 22, 23, 24, 25, 26, 27 and 31 shall apply from 1 January 2026. (c) Articles 33, 34 and 35(1), (2), (3), (4), (6) and (7) shall apply until 31 December 2025…”.

It means that-without going deeper into the contents of articles:

  1. from 31.12.2024 will enter into force the articles on: application for an authorization (for the status of authorised CBAM); CBAM authorization;
  2. from 1.01.2026 will enter into force the rules about essentially: CBAM declaration, obligations and rights of CBAM declarants; rules applicable to the importation of goods;
  3. until 31.12.2025 will be operative the article on importation of goods and obligation of reporting some data.

Finally, the CBAM will be an interesting point to get and maintain the AEO authorization.
